When asking if you are an employee or an independent contractor, some questions that should come to mind are: How are my responsibilities and duties dictated? Who provides the equipment I work with? Who controls the hours I work? Am I paid a regular wage and receive employee benefits?
Misclassification of employment status may be an innocent mistake by the parties involved, or a conscious decision made by an employer to avoid certain costs and responsibilities as legislated by the Employment Standards Act or Code.
