When asking if you are an employee or an independent contractor, some questions that should come to mind are: How are my responsibilities and duties dictated? Who provides the equipment I work with? Who controls the hours I work? Am I paid a regular wage and receive employee benefits?
Misclassification of employment status may be an innocent mistake by the parties involved, or a conscious decision made by an employer to avoid certain costs and responsibilities as legislated by the Employment Standards Act or Code. In either case, the penalty for making the wrong distinction can lead to big problems for both employer and employee.
